Seattle Dog Walker Charged With Thefts

Filed under: Legal News — Tags: — enux @ 8:13 pm

A dog walker,  Seattle resident Mary Winslow Chodl, has been charged with possibly stealing items from her customers. Of course, she is innocent untill proven guilty.

All in all, she was charged with first degree theft, second degree theft, identity theft and trafficking stolen property, by the local Prosecutors Office. According to Medina Police spokesman Dan Donohoe, Chodl might face further criminal charges as the investigation is continuing. She might just need a good criminal attorney for this one.

The charges come after a complaint by one of Chodl customers who stated they were missing over $110,000 in jewelry and related personal items. Chodl stands accused of stealing jewelry, artwork, carpets, clothing items and other property from her said customers, some of which she is accused of pawning. Chodl is accused of allegedly stealing a wedding ring valued at $55,000 and a gold watch that she allegedly sold for $1500. By the way if you live in Seattle and you need an excellent Seattle criminal attorney then may I suggest the Law offices of Jason Newcombe as he is indeed one of the better seattle criminal attorney working right now.

The Medina females whose items were allegedly stolen by Chodl called police December 5th after she found the wedding ring and watch missing, she also stated the Chodl who had walked her 3 canines for six years and one other person had access to the home. Chodl when questioned stated to police according to Medina Police Chief Jeffery Chen that the client is known to misplace items.

The authorities inspected Chodl’s apartment after obtaining a warrant where they then discovered certain stolen property items.

Sounds like Chodl can expect some criminal charges coming down the pike sometime soon. Better call that attorney sometime soon.

It was also reported when Chodl was arrested at her residence she was in possession of two credit cards and a drivers license belonging to another person.

‘Discovery Coverage’ and Directors’ and Officers’ liability Insurance

Filed under: Legal News — Tags: — enux @ 8:04 pm

Here is an excellent article written by one of our expert writers, Todd A Picker, who is a leading Orange County Accident Attorney:
American Casualty Co. v Baker
Directors’ and officers’ liability insurance policies typically permit the insured to purchase ‘discovery coverage’ when the policy is cancelled or is not renewed. In the past courts in the United States have had difficulty defining clearly the scope of protection afforded to the insured by such ‘discovery coverage’. As a consequence, some courts have reached contra¬dictory results when interpreting ‘discovery coverage’ provisions. This analysis examines the impact that a recent decision by the US Court of Appeals for the Ninth Circuit, American Casualty Co. v Baker, will have on this area of the law.
It is not uncommon for directors’ and officers’ liability insurance to include provision for extended coverage on the insurer giving notice of its intention to cancel or its refusal to renew the policy. In general, the insured is given the right to purchase additional coverage, sometimes referred to as ‘discovery coverage’, for claims’ made during a period of time following the date of cancellation or non-renewal. The savings and loan crisis in the United States has, not surprisingly, led to a reluctance on the part of some insurers to remain in the directors’ and officers’ liability insurance market. As insurers seek to cancel or refuse to renew direc¬tors’ and officers’ policies, the extended coverage typically found in such policies has taken on added significance.
Predicting how courts in the United States will resolve issues related to how and when ‘discovery coverage’ applies has proven to be a difficult undertaking given the con¬flicting appellate decisions on the subject. In particular, the courts that have attempted to answer the question of whether ‘discovery coverage’ encompasses occurrences which have not yet ripened into claims have failed to do so with any consistency. A recent decision by the United States Court of Appeals for the Ninth Circuit however provides hope that some semblance of order will be restored to this area of the law.
Background
In American Casualty Co. v Baker, the officers and directors of an insolvent savings and loan association, Pacific Savings Bank (’Pacific’), sought insurance coverage for claims asserted against them by the Resolution Trust Corporation CRTC’).l In February 1989 Pacific was declared insolvent
1 All directors’ and officers’ policies are written on a ‘claims made’ basis. Coverage is determined with reference to when a claim is presented rather than when the wrongful conduct occurred, as would be the case with ‘occurrence’ based policies.
2 22 F.3d 880 (9th Cir. Cal. 1994).
3 The RTC is an agency of the US Government which was created for, inter alia, the purpose of managing and resolving all cases involving insolvent savings and loans (12 USC section 1441a(h)(3)).
by the Federal Home Loan Bank, and the Federal Savings & Loan Insurance Corporation (’FSLIC’) was appointed as conservator. Subsequently, the RTC was assigned4 all rights in am actions, judgments or claims against any of Pacific’s directors. employees and any others whose action or inaction may have related to any loss incurred by Pacific. By the way if you live in Orange County and you need a superb Orange County accident Attorney then I would like to recommend the Law Offices of Todd Picker as he is one of the best Orange County accident Attorney working right now, in my humble opinion. A lawsuit to recover damages from Pacific’s directors and officers was ultimately filed in June 1989. According to the RTC, Pacific’s officers and directors were allegedly responsible for involving Pacific in a programme of high-risk com¬mercial and construction lending and investment which, while appearing profitable, in fact concealed losses

Four Arrested In Criminal Plot To Kill Mother

Filed under: Legal News — Tags: — enux @ 8:01 pm

Heading to Sacramento soon but wanted to add this criminal news article:

According to reports Nikita Lee Weis was arrested for allegedly conspiring to commit first degree murder, along with his girlfriend and the two suspected hit men. Its alleged according to Deputy Police Chief Mike Barnett of the Fountain Police Department that Nikita Weis made a deal with two men to pay them $7,000 to break in his mothers home, kill her and dispose of her body.

After the alleged deal Hyun Weis was attacked at her home with a small wooden baseball bat, she scared off her criminal attacker by setting off her car alarm according to Barnett. Hyun Weis was hospitalized and released.  Obviously, someone will need a competent criminal defense lawyer, big time.

The four were arrested according to the arrest affidavit after trying to cause Hyun Weis harm the night prior to the incident but she did not answer the door. The next night Nikita was at her home when an attacker came in the home and beat her with a small wooden bat. This is when she set off her car alarm and scared the man away. She then went to a neighbor’s and called 911. Incidentially if you happen to reside in Sacramento (or nearby communities such as Fresno and require a superb Sacramento criminal defense lawyer then I highly recommend the Law Offices of Patricia Tilley. She is a first rate Sacramento criminal defense lawyer to be certain and can help with a broad array of cases.

Nikita and his girlfriend returned to Hyun Weis’s home where they told police they had been held at gunpoint. They were taken into police custody and later admitted to their part in the planning of the criminal attack. According to Barnett Sophia Nicole Alsept the girlfriend of Nikita waited outside with the second man, Juan Antonio Velez Gonzalez during the attack, while Brandon Michael Soroka went into the Weis home with a bat.

Not much defense for that kind of criminal behaviour.

According to Barnett they had planned wrapping Hyun Weis’s body in plastic and dumping her body in New Mexico or Arizona in the desert. They also discussed possibly burying her body in a remote area in the vicinity of Garden of the Gods Road.

Criminal Legal News from Los Angeles

Filed under: Legal News — Tags: — enux @ 6:01 pm

In criminal legal news coming out of Los Angeles (specifically Long Beach), a Long Beach mother, Eva Dailey, has been convicted of second degree murder in the death of a 13 year old boy. Dailey was convicted in the murder stemming from the murder last year when she was arrested for driving her son and his friends from the scene of the murder. Daley was sentenced 15 years to life in Los Angeles County Superior Court in front of Judge Arthur Jean after jurors believed that the attack and murder of Jose Cano was gang related. Not sure what the defense will be there.

During the trial Deputy District Attorney John Lonergan provided evidence that the criminal attack on the 13 year old Jose Cano was planned and was revenge for a roadside flares that were thrown near the apartment building Daley and her son lived by the gang that Jose Cano belonged. Obviously a good criminal defense attorney is required here.

Witnesses that testified against Daley were some of her son’s friends that have also admitted being involved in the murder. They stated that Daley picked them up and drove them to the 14th Street Park area where the attack took place. Another witness that testified was a person who was walking their dog and testified he heard a woman in a white SUV shouting to the boys “Lets go, come on, come on.” Incidentially if you reside in Los Angeles and you find yourself in need of a tip top Los Angeles criminal defense attorney then you should give Ramiro Luis a jingle. He is indeed a leading Los Angeles criminal defense attorney and he also services other areas like Van Nuys, Long Beach, Fresno and Compton.

Police later found blood from the victim and Daley’s son Heriberto Garcia inside the SUV.  Not sure what their defense to that could be.

Lonergan also said that her story where she portrayed herself as a single mother struggling with three children who did not know her son was involved in a criminal gang. Daley also testified she was driving her son to a friends house when the gang of boys jumped out of her Chevrolet Tahoe and carried out the assault on Jose Cano.
