As insurers seek to cancel or refuse to renew direc¬tors’ and officers’ policies, the extended coverage typically found in such policies has taken on added significance.
Predicting how courts in the United States will resolve issues related to how and when ‘discovery coverage’ applies has proven to be a difficult undertaking given the con¬flicting appellate decisions on the subject. In particular, the courts that have attempted to answer the question of whether ‘discovery coverage’ encompasses occurrences which have not yet ripened into claims have failed to do so with any consistency.
