Illinois Firm Portola Completes Chapter 11 Bankruptcy

A leading manufacturer, Portola Packaging, has emerged from Chapter 11 bankruptcy protection. The restructuring that took place greatly reduced the total outstanding indebtedness and interest expenses of Portola Packaging. According to reports, they were able to eliminate $180 million of their total debt. The United States Bankruptcy Court had confirmed the Portola Packaging Company’s restructuring plan and the company converted all of there 8.25% senior notes into equity. And they did not need any funds from Washington.

The Portola Packaging Company which operates in Batavia, Illinois, makes tamper evident closures, plastic containers, cosmetic packaging along with related products and engineering services of the dairy, juice water and cosmetic industries. The Delaware Bankruptcy Court had ruled that Portola met its statutory requirements and pre-packaged chapter 11 plan of reorganization and would be emerging from chapter 11 in late October, according to the laws. This whole thing sort of reminds me of the earlier Washingtom Mutual situation.

Portola was able to obtain exit financing from Wells Fargo Foothill, LLC and Regiment Capital Special Situations Fund IV LP for a $66 million senior secured credit facility. Secondary financing by Wayzata Investment Partners LLC (Wayzata”) was also obtained to refinance the second lien debt upon exiting Chapter 11. By the way if you happen to be looking for someone who knows about washington bankruptcy laws then might I suggest Jason Newcombe as he is one of the leading Washington Bankruptcy Law specialists out there and can help you with many cases. He is sevices Seattle and greater Puget Sound/Washington/ area.

Investment holders of the Portola existing senior unsecured notes received 100% of Portola’s common stock that was reorganized, according to the laws.

The Yearly “State of Real Estate” Report and 2009 Forecast for Hawaii

Filed under: Real Estate — Tags: — enux @ 9:04 pm

Prudential Locations, which is the state of Hawaii’s biggest home-grown real estate firm, has just now released their yearly “State of Real Estate” research report for 2009.
They are a leader on Oahu, Maui, Big Island, Kauai, Molokai, and Lanai, with detailed property purchase data for all of those named markets.
This rather seeeping report goes into some degree of detail concerning how the Hawaii real estate market
did this year and also examines how the firm anticipates the market to perform next year. it should be an interesting year for sure.
All in all, it appears that this year will finish with just under thirty percent less total purchases than last year. Apparently, average condo unit prices have remained about the same while house prices have dipped by around 3.1 percent.
Going into next year, the firm expects that prices will dip a further 6-10% by the middle of next year, largely because of poor consumer confidence levels.
Furthermore, the firm predicts the total amount of purchases next year will slide by a full quarter as compared to this year.
On top of that, they predict that next year will be great for investors with fast dropping prices, good interest rates and lots of real estate available.
it appears that Kauai real estate will probably be better off than some of the other islands for a number of reasons including a lack of new building permits. I have seen the Kauai real estate market break out of a slum before, in particular after the 1992 Hurricane Iniki damage, so I am probably more optimistic than most at this time.

Chemical Reaction Prompts Evacuation of Midwest School

Filed under: National News — Tags: — enux @ 9:16 pm

I recently returned from the Seattle area and wanted to post this story: A hazardous materials spill caused a minor explosion in a science lab Thursday afternoon, prompting a brief evacuation of a northwest suburban high school in Illinois.
About 12:50 p.m., students and faculty at Hoffman Estates High at 1100 W. Higgins Rd. were sent outside in response to a fire alarm prompted by a chemical reaction, according to an alert on the school Web site. Students were later transferred to the gymnasium.

No students were injured, but two staff members were sent to St. Alexius Medical Center in Hoffman Estates as a precaution, according to a joint release from the Hoffman Estates Police and Fire departments.

One of them inhaled vapors and was expected to be released from the hospital Thursday afternoon, Fire Chief Robert Gorvett said. By the way if you live in Seattle and need a top rated Seattle Criminal Attorney then may I suggest Blair & Kim, PLLC. They are in fact excellent Seattle Criminal Attorney and can help you with a wide array of different cases.

The spill occurred when someone dumped an unknown chemical into a sink in a science lab. The chemical reacted with water in the drain trap and caused the drain pipe to blow open. The small explosion knocked over some household cleaning chemicals, which spilled onto the floor of the lab, according to Gorvett.

The incident occurred in a “non-student preparation area” being cleaned and packed for a scheduled move due to an upcoming construction project. The chemical reaction caused a vapor cloud that activated a smoke detector, but no students were in the room at the time, the release said.
It does not appear to be criminal related at this time, so I doubt if any of the students needs to rush out and get an attorney. Well it is nice to be back from Seattle, I had a great time.

Preparing your Dog or Cat for the Cold

Filed under: Animals — Tags: — enux @ 8:57 pm

This excellent article initially appeared in the November 2008 Healthy Pet Net Newsletter, which is dedicated to the health of dogs, cats and other companion animals. It has been partially edited for length purposes:

The cold winds of winter are beginning to blow through the country. Certain regions are therefore experiencing sooner and larger than expected snowfalls. So, what can you do to make sure your dog or cat is prepared for these months?
Well for one, if your pet happens to be arthritic, be certain not to leave him/her outside for a long period of time. Just as with people, these colder temperatures may make arthritic joints even more rigid and painful.
In addition, Dogs which often walk on sidewalks and streets should have their paws cleaned upon re-entering the house. Rock salt and related chemicals may sometimes collect in their pads and cause irritation.
Furthermore, check outside food and water bowls often during the day for signs of freezing. For a modest price, you may get a premium heated bowl to make certain that your dog or cat will always have access to tepid water and warm food even when the temperature drops. Speaking of food, it helps if you feed them premium cat food or dog food as this will help their metabolism, which will of course help them bear the burden of the toupher weather conditions. If you are interested in premium cat food or dog food you may wish to visit Petfoodretail.com as they have some of the best.
Try to bear in mind that both dogs and cats have to burn more calories to stay warm during the cold months, especially if your pet will be frequently outdoors. Consider increasing the amount of food you feed by 10–20% overall, says holistic veternarian Dr. Jane Bicks.

‘Discovery Coverage’ and Directors’ and Officers’ liability Insurance

Filed under: Legal News — Tags: — enux @ 8:04 pm

Here is an excellent article written by one of our expert writers, Todd A Picker, who is a leading Orange County Accident Attorney:
American Casualty Co. v Baker
Directors’ and officers’ liability insurance policies typically permit the insured to purchase ‘discovery coverage’ when the policy is cancelled or is not renewed. In the past courts in the United States have had difficulty defining clearly the scope of protection afforded to the insured by such ‘discovery coverage’. As a consequence, some courts have reached contra¬dictory results when interpreting ‘discovery coverage’ provisions. This analysis examines the impact that a recent decision by the US Court of Appeals for the Ninth Circuit, American Casualty Co. v Baker, will have on this area of the law.
It is not uncommon for directors’ and officers’ liability insurance to include provision for extended coverage on the insurer giving notice of its intention to cancel or its refusal to renew the policy. In general, the insured is given the right to purchase additional coverage, sometimes referred to as ‘discovery coverage’, for claims’ made during a period of time following the date of cancellation or non-renewal. The savings and loan crisis in the United States has, not surprisingly, led to a reluctance on the part of some insurers to remain in the directors’ and officers’ liability insurance market. As insurers seek to cancel or refuse to renew direc¬tors’ and officers’ policies, the extended coverage typically found in such policies has taken on added significance.
Predicting how courts in the United States will resolve issues related to how and when ‘discovery coverage’ applies has proven to be a difficult undertaking given the con¬flicting appellate decisions on the subject. In particular, the courts that have attempted to answer the question of whether ‘discovery coverage’ encompasses occurrences which have not yet ripened into claims have failed to do so with any consistency. A recent decision by the United States Court of Appeals for the Ninth Circuit however provides hope that some semblance of order will be restored to this area of the law.
Background
In American Casualty Co. v Baker, the officers and directors of an insolvent savings and loan association, Pacific Savings Bank (’Pacific’), sought insurance coverage for claims asserted against them by the Resolution Trust Corporation CRTC’).l In February 1989 Pacific was declared insolvent
1 All directors’ and officers’ policies are written on a ‘claims made’ basis. Coverage is determined with reference to when a claim is presented rather than when the wrongful conduct occurred, as would be the case with ‘occurrence’ based policies.
2 22 F.3d 880 (9th Cir. Cal. 1994).
3 The RTC is an agency of the US Government which was created for, inter alia, the purpose of managing and resolving all cases involving insolvent savings and loans (12 USC section 1441a(h)(3)).
by the Federal Home Loan Bank, and the Federal Savings & Loan Insurance Corporation (’FSLIC’) was appointed as conservator. Subsequently, the RTC was assigned4 all rights in am actions, judgments or claims against any of Pacific’s directors. employees and any others whose action or inaction may have related to any loss incurred by Pacific. By the way if you live in Orange County and you need a superb Orange County accident Attorney then I would like to recommend the Law Offices of Todd Picker as he is one of the best Orange County accident Attorney working right now, in my humble opinion. A lawsuit to recover damages from Pacific’s directors and officers was ultimately filed in June 1989. According to the RTC, Pacific’s officers and directors were allegedly responsible for involving Pacific in a programme of high-risk com¬mercial and construction lending and investment which, while appearing profitable, in fact concealed losses

Police fatally shoot Los Angeles man by Accident

According to reports the Culver City Police fatally shot a man by accident after he apparently did not follow their orders and appeared to be reaching for his waistband. The shooting took place in near Los Angeles in Venice after police stopped the man, because his vehicle matched a vehicle that was seen leaving a crime scene. it was obviously an innocent mistake and it is highly doubtful that the officer in question will need an attorney for this accident.

All in all, Deputy Derrick Thompson of the Los Angeles County Sheriff’s Department stated that the shooting in question occured at around 12 A.M. in the area of California Avenue and Frederic Street. The authorities there pulled the car over as it matched the description of a particular car which had been at a crime scene where an individual had been attacked with a lethal weapon. Incidentially if you happen to live in Los Angeles or the greater LA area and need a top rated accident attorney Los Angeles then may I suggest the esteemed Law Offices of Steve Sweat. He is simply an excellent accident attorney Los Angeles and may assist you with a wide array of different legal cases including motorcycle, truck and car accident cases. In addition to Los Angeles he also covers nearby areas such as malibu, Torrance, Beverly Hills, pasadena and Redondo beach, among others. Now back to the article:

Deputy Thompson reported that a man exited the said car after it was pulled over and refused to comply with his instructions. When it looked like he might be making a move which caused the officer involved in the shooting to fear for his life, the unfortunate accident then occured and the man was shot and, eventually, fatally injured.

In an inspection of the car a firearm was found and 2 additional individuals in the car were arrested and booked. Deputy Thompson did not comment on how many shots were fired or how many Culver City Police officers were actually involved. He also reported there is an internal investigation ongoing into the accident at this point in time.
